Default Rental Agreement

Applies to every booking unless the Lender and Lendee agree in writing to different terms.

By submitting a booking, the Lendee and Lender enter into a short-term rental agreement directly with each other. The platform owner is not a party to this agreement. 1. Deposit. Each listing has a refundable damage deposit set by the Lender. The Lendee agrees that the deposit is FORFEITED IN FULL to the Lender if the item is (a) damaged beyond ordinary wear and tear, (b) lost or not returned, or (c) returned late beyond the booking end time without the Lender's written agreement. Payment and refund of the deposit happen directly between the parties. 2. Condition, inspection, and return proof (rental-car standard). (a) No damaged items. The Lender warrants that the item is, to their knowledge, in safe and working order at the time of pickup, is not broken, defective, recalled, or missing critical parts, and that every visible blemish, mark, scuff, stain, dent, scratch, or worn area has been fully disclosed in the listing with clear photos. Undisclosed pre-existing damage may not be charged to the Lendee. (b) Pre-rental inspection. Before the rental period begins, the Lendee will inspect the item in person (or upon delivery) and acknowledge its condition in the Lend Me app, the same way a renter signs the walk-around sheet at a car-rental counter. If the Lendee does not complete the in-app condition acknowledgment, the booking is void, any payment is refunded, and the Lender bears responsibility for the failed handoff. (c) Use. The Lendee will use the item only for its intended purpose and will not sublet, resell, pawn, or transfer it. (d) Return condition and proof. The Lendee will return the item in the same condition it was received, accounting only for ordinary wear and tear, and will upload a clear, dated return photo of the item in the Lend Me app to close out the transaction. The Lender will confirm receipt. If no return photo is uploaded within 24 hours of the scheduled return, the deposit hold is extended and any later damage dispute defaults in favor of the Lender. (e) False damage claims. A Lender who attempts to charge for damage that was visible in the disclosed pickup photos, or that the Lendee acknowledged at pickup, forfeits the deposit claim in full and receives a strike on their account. 3. Vehicles. Vehicle rentals additionally require the Lender to maintain auto insurance that includes uninsured/underinsured motorist coverage for the duration of the rental, and the Lendee must hold a valid driver's license. 4. No money lending. Cash, gift cards, crypto, and other monetary instruments may not be the subject of a rental on Lend Me. 5. Liability. Each party is responsible for their own actions. The platform owner has no liability arising out of any rental and provides no insurance, escrow, or guarantee of any kind. 6. Disputes. The parties will attempt to resolve disputes directly. Either party may report safety, fraud, or policy violations to the platform owner using the Report button on the listing.
