Default Rental Agreement

Applies to every booking unless the Lender and Lendee agree in writing to different terms.

By submitting a booking, the Lendee and Lender enter into a short-term rental agreement directly with each other. The platform owner is not a party to this agreement. 1. Deposit. Each listing has a refundable damage deposit set by the Lender. The Lendee agrees that the deposit is FORFEITED IN FULL to the Lender if the item is (a) damaged beyond ordinary wear and tear, (b) lost or not returned, or (c) returned late beyond the booking end time without the Lender's written agreement. Payment and refund of the deposit happen directly between the parties. 2. Condition and use. The Lendee will use the item only for its intended purpose, will not sublet or resell it, and will return it in the same condition it was received. The Lender warrants that the item is, to their knowledge, in safe working order at the time of pickup. 3. Vehicles. Vehicle rentals additionally require the Lender to maintain auto insurance that includes uninsured/underinsured motorist coverage for the duration of the rental, and the Lendee must hold a valid driver's license. 4. No money lending. Cash, gift cards, crypto, and other monetary instruments may not be the subject of a rental on Lend Me. 5. Liability. Each party is responsible for their own actions. The platform owner has no liability arising out of any rental and provides no insurance, escrow, or guarantee of any kind. 6. Disputes. The parties will attempt to resolve disputes directly. Either party may report safety, fraud, or policy violations to the platform owner using the Report button on the listing.
